Speaker Pelosi Intends to Codify Roe v. Wade

The measure could face an uphill battle.

After the Supreme Court issued its 5-4 decision Wednesday rejecting a challenge to a Texas law that prohibits the abortion of an unborn baby once a heartbeat can be detected, Speaker of the House Nancy Pelosi of California said that upon Congress’ return from recess, the House will vote to create a law guaranteeing women the right to abortion nationally.  She said, “This ban necessitates codifying Roe v. Wade.”

“Upon our return, the House will bring up Congresswoman Judy Chu’s Women’s Health Protection Act,” the speaker said.

However, the measure could face an uphill battle in the divided Senate, as there are some within Speaker Pelosi’s party who do not support the Senate version of the Chu measure, specifically Senators Joe Manchin of West Virginia and Bob Casey of Pennsylvania.

Meanwhile, Senator Ed Markey of Massachusetts called for eliminating the Senate filibuster to allow legislation codifying Roe v. Wade to pass with a simple majority. President Biden was also critical of the Court for its ruling, saying it would cause “unconstitutional chaos” by the enforcement of a ban on abortion.

From 1976 to 2012, the nation saw more than one million abortions each year, according to the National Right to Life Committee released last January. At the same time, the CDC said its tracking data showed 62,502,204 abortions during the same period. Those numbers have accelerated in the intervening years.
